New eligibility criteria for open work permits (PTO)
LIST OF 2 AND 3 OCCUPATIONS ELIGIBLE FOR OPEN WORK PERMIT APPLICATIONS FOR SPOUSES AND DEPENDENT CHILDREN
As announced by the federal government, the eligibility criteria for PTO applications for PTO applications for spouses and dependent children of temporary foreign workers have been updated. We described the basic changes to you when we last posted. On January 22, 2025, the list of specialized occupations, FEER 2 and FEER 3, was published.
Basically:
Temporary foreign workers holding a FEER 0 (Management) and 1 (University degree) position are eligible.
However, some workers in such a specialized but technical position (FEER 2 and FEER 3) are also eligible. The rationale is that these technical occupations are directly affected by a severe shortage of labour across Canada, from coast to coast.
It should be noted that the provision allowing for an open work permit to be obtained for dependent children over the age of 18 has finally been abolished. So bed is not possible.
